Preliminary inquiry underway in connection with fatal ambush shooting of Calgary woman
A five-day preliminary inquiry got underway Monday for the Edmonton-area man charged with murder in the ambush of a Calgary couple. A preliminary inquiry is underway in connection with the fatal shooting of Calgary woman, Baron, and Fouani, who were ambushed in their Bentley car in 2022. Baron was killed and Fryani was critically wounded, but has since recovered. Fouani was facing criminal charges related to money laundering, possession of stolen property over $5,000, and involvement in a criminal organization. His lawyer, Yoav Niv, has applied to withdraw the guilty plea and have all charges stayed due to unreasonable delay. The preliminary inquiry will determine if there is any evidence upon which a jury could find Arnold guilty. Arnold remains in custody pending trial.

The couple were ambushed in their Bentley car as they pulled out of the driveway of their home in the community of Evergreen Estates on Aug. 18, 2022. Baron was killed and Fouani was critically wounded, but has since recovered. At the time, Fouani was facing criminal charges of money laundering, possession of stolen property in excess of $5,000 and partaking in a criminal organization. In March he pleaded guilty to the money laundering allegation, but his lawyer, Yoav Niv, has since filed an application to withdraw the plea. Niv has also applied to have all charges against his client stayed because of unreasonable delay.
Mograbee and Taylor expect to call 11 witnesses over the course of the week-long preliminary inquiry, which is to determine whether there is some evidence upon which a jury could find Arnold guilty. The authorities have not said there is a link between the charges Fouani was facing and the shooting of the couple. Graphic video of the ambush, captured on a neighbour’s security camera, was made an exhibit in an unsuccessful publication ban bid by Fouani in the money laundering case. Arnold, who was arrested just days after the shooting, remains in custody pending trial.
